RULES AND REGULATION OF PARAM PITA SHAH SATNAM JI EDUCATIONAL & WELFARE SOCIETY SIRSA.

1. INTRODUCTION
WHEREAS, there are number of private and other schools, colleges, hospitals and research institution in india but the education in these schools and colleges, medical treatment in the hospitals and research work is very expensive and keeping in mind these
very facts and to uplift the poor and the down trooden people of the society living in India, to promote brother-hood and social welfare, to impart education to poor students and to provide medical assistance to the poor people of india, it was felt necessary that a society be framed.


Accordingly a society namely:-

"PARAM PITA SHAH SATNAM JI EDUCATION AND WELFARE SOCIETY SIRSA"

(hereinafter referred to as the 'SOCIETY') was formed and its rules and regulation were framed in accordance with consonance at a public meeting/gathering of the society.

2. NAME OF THE SOCIETY:
The society shall be named "PARAM PITA SHAH SATNAM JI EDUCATIONAL AND WELFARE SOCIRTY SIRSA" and shall be a registered one.

3. REGISTERED OFFICE OF THE SOCIETY:
PARAM PITA SHAH SATNAM JI EDUCATION AND WELFARE SOCIETY SIRSA,BEGU ROAD,SIRSA DISTT.SIRSA.

4. AIMS AND OBJECTS OF THE SOCIETY:
The aims and objectives of the society are as follows:-
a) to start schools, colleges, at sirsa or any other place deemed fit
by the members of the society in india, and to run the same for
the benifite of all persons, without distinction of caste, creed or
colour.
b) to run hopitals and research institution, for providing medical
assistance to the poor and downtrdeen peoples of the society of
India.
c) To start Dharamshala,any other institution or Institution for
education or medical aid for the benefit of all persons without
any distinction of caste, creed or colour.
d) To establish Libraries,to disseminate,publish and distribute lite-
-rature for the welfare of the people as well as religious educat-
-ion among the people in india by the society.
e) To give donation to yhe Institution doing similar or allied work.
f) The Ist aim of the society is to run a schools at sirsa under the
name of PARAM PITA SHAH SATNAM JI GIRLS HIGHER
SECONDARY SCHOOLS, SIRSA.
g) To grant lump sum or periodical assistance to the poor students
for their education or to the poor widows for their maintenance
or to the poor persons for medical relief and also to grant
recoverable loans for such purposes without distinctions of
caste,creed and colour.To do all other works for the advance-
ment of the above purposes.
h) To do all other things that may be incidental and relevant or
otherwise helpful for the attainment of the above objects.
i) The income and the property of the society shall be applied
solely towards the promotion of the objects of the society as set
forth in the memorandum of the association and no portion there
of shall be paid or transferred, directly or indirectly ,to the me-
-mbers of society.
j) No members of the governing body of the society shall be app-
ointed to any salaried office of the societyor any office of the
society paid by fees, that no remuneration shall be given by the
society to any members of such governing body except repaym-
-ent of out of pocket expences and interest on money lent or rent
for premises/demises to the society.
k) The society, by its constitution is required to apply its profit,if
any or other income in promoting its objects.
l) To check the social, evils like eating animals flesh drinking li-
-quor and prostitution etc. and to remove the said society evils
from the society and to educate the people for these social
evils and to prepare the people not to indulge in these social
evils.
if upon the winding up or dissolution of the society there
remains after satisfaction of all its debts and liabilities, any
property whatsoever, the same shall not be paid to or
distributed among the memb of the society but shall be given
or transferred to some other institution having objects similer
to the objects of the society to be determined by the member of the society at or before the time of dissolution

5. THE TERMS OF ADMISSION OF MEMBERS:-
every members above the age of 18 years can became the member of the society provided he agreed to pay regularly annual subscription of Rs 100/ - (Rs 100 only and further agrees to abide by the rules and regulation of the society.

6. THE CONSEQUENCES OF NON-PAYMENT OF SUSBSCRIPTION OR FINE.
Any member who has failed to pay annual subscription for a period of more than one year shall automatically cease to be a member of the society after the subscription for one year falls in arrears. such a member shall not be competent to contest election for governing body or the society nor he shall have a right of vote.

7. THE FINES AND FORFETURES TO BE IMPOSED ON ANY MEMBER:
Any member who works against the interest of the society in the opinion of the governing body of the society may be terminated from the membership of the society and the society may imposed any fine on such member for mis-conduct which will be recoverable as a social of obligation.

8. CATEGORIES OF MEMBERS OF THE SOCIETY:
A person who pays regularly Rs 100 per annuam as subscription to the society shall be the member of the society.

9. RESIGATION AND EXPULSION OF MEMBER(S)/OFFICE BEARERS RESIGNPTION
any members or office bearers may resign from the membership or office by sending his resignation in writing to the president of the society. The resignation will be effective, from the date of its acceptance by the Governing Body.
EXPULSION:
The General Body is empowered to expell and remove by 2/3rd majority any member or of ice-bearer or member the governing body whose activities may be considered to prejudicial to the society.A member shall automatically be ezpelled and removed,if found to consuming liquor or eating animal flesh.

10.FORMATION OF GENERAL BODY
It shall include all members of the society ,who are above the age of 18 years and who have regularly paid the subscription fixed by the society from time to time and who have applied for being enrooled as a member.
The General body shall be the supreme body of the society and it shall have powers to amend the constitution and to change or suspend any regulation passed by the Executive Committee,which it considers to be contray to the spirit of consitution but no amendment of the constitution shall be valid unless it is raised by atleast 2/3rd majority of the total membership.

11.POWERS AND FUNCTIONS OF THE GENERAL BODY
a)To prepare and pass annual budget of the society.
b) To appoint ,suspend or dismissed any employee of the society of tempel or institution or of any institution being managed or run by the society.
c) to control and adminsiter institution trust of the society.
d) to purchase ,sell or mortage any property of the so society.
e) to manage,control and adminsiter any other movable or immovable property of the society which may vest in the society.
f)to direct filling of suits in law courts on behalf of the society for the benefit of the society,to control and adminsiter any institution or trust.
g)to amend or withdraw resolution relating to any of the aforesaid matters.

12.MEETING/QUORUM OF THE GENERAL BODY.
a)All the meetings of the general body shall be presided over by the president and in his absence.the vice president and in absence of both the members present meeting shall elect one from among themselve to preside over the meeting.
b)the secretary of the society shall circulate among members the agenda for the meeting at least 24 hours before the meeting.
c)the notice of the ordinary meeting of thegeneral body shall not be less than three days but an extra ordinary meeting may be convened at 24 hour notice but the notice for the election of meeting shall not be less than four clear days.
d)That on the written requisition of one-third of the total members of the society,the president shall convene an extra-ordinary meeting of the society within a period of fornight of receipt of such requisition,failing which the members shall be competent to cinvene the meeting themselve subject to all the rules and regulations of the society.
e)The quorum for the ordinary member of the general body shall be 1/3rd & for requisition meeting shall be 3/4th of the total member.there shall be no quorum when the meeting is re-convened after adjourment for want of the quorum.

13- Formation of Governing Body/Executive Committee.
The governing body of the society shall have the total strength of 11 members including ( President.Vice President,Secretary,Cashier,
the office-bearers.) It shall be formit as hereinafter mentioned in the Memorandum of the association.All the members &the office-bearers shall be elected by the general body by election following simply majority system. The office-bearers shall be members of the governing body by virtue of their office.

14-Mode of election governing body.
The office-bearers & the other members of the governing body shall be elected at a specially convened annual meeting for such purposer for amongst members of the general body by a majority votes but the tenure of the present governing body will be of 2 years.The meeting will be presided over by unanimously resolved member of the general body or in the absence or any such unanimous decision by senior most (in ages)member of the general body. For the election of the office-bearers or member of the governing body,member shall be eligible for re-election but no member shall be eligible to hold more than 1 office.A member whose subscription for more than 1 year is in arrears,shall not be eligible for such election.The general body shall have the power to extend the tenure of office-bearers & the governing body.

15-powers and function of the governing body.
a) the governing body of the society will be empowered to look after & carry on the works of the society.
b)the governing body shallbe competent with the permission of the general body given to ot through a resolution passed at any meeting specially convened for this purpose and comprised of at-least 3/4th of the members on its pool to alinate any immovable property of the society in accordance with the law on the subject and the governing body may authorise through a separate resolution of the office-bearers to execute and to get registered any deed that purpose.
c)the governing body through a duly passed resolution by simple majority shall be competent to authorize any member or office-bearer to file or defend any suit by or against the society and to sign the pleadings and other documents and to make any statement or to give evidence on behalf of the society.
d)any sub-committee appointed by the governing body the administration of any of the failing which the member shall be competent to convene the meeting themselves subject to all the rules and regulations of the society.
e)thye quorum for the meeting of the governing boby shall be 1/2share of the total members and for meeting re-convened after adjournment,due to want of quorum thereof will be no quorum.

16.POWER AND DUTIES OF EACH OF THE OFFICE-BEARERS SEPARATELY:-
a)PRESIDENT:
the president will:-
1)presice over all the meeetings of the society when present.
2)represent the society on all the occasions unless any member is deputed to represent the society on any specific occasions.
3)issue orders to other office-bearers and employees for the welfare of the society.
4)to act and implement the advice of the members.
5)generally supervise and control the affairs and activities of the society and maintain its dignity.
6)to incurr and sanction any expenditure upto rs.15000/-
7)to sign alongwith the cashier cheque/s of the bank account.
b)VICE PRESIDENT:
the vice prsident shall act and carry out the functions of the society in the absence of the president .
c)THE SECRETARY:-
the secretary shall subject to the orders of the president:-
1)issue notices of the meetings.
2)to maintain in records and the minutes of the proceedings of the meetings.
3)carry on correspondence on behalf of the society maintain a record therof.
4)to maintain a stock register/property register of the society.
5)to transact all other business of the society.
6)carry into effect and implement all the resolution of the society and its governing body.
7)supervise and control the employees and other staff of the society.
8)the secretary shall maintain the following regist of the record.
a)a minute book.
b)a correspondence book.
c)a peopn book.
d)a subscription register.
e)a register of approved members.
f)a stock register.
g)an attendence register of employees and other staff.
h)the property register.
and other register/s which he may consider necessary.
d-CASHIER:
1) the cashier shall be responsible for keeping all the accounts of the society.He shall be competent to keep rs.10000/- as cash in his hand and he shall make payment in accordance with the bills passed by the president for a sum of not more than rs.15000/-.
2) the bills of the values of more than rs.15000/-shall be passed both by the president and cashier jointly.
3) the cashier will maintain regular accounts and send a copy of accounts to the president and members of society.
4) the bank account shall be operated by the president and the cashier jointly by signing cheque upto the sum of rs.15000/-.
5) to recover and keep records of subscription from the members of the society.

17.THE MANNER FOR THE INVESTMENT OF THE FUNDS KEEPING OF ACCOUNTS AND FOR ALL ANNUAL OF PERICDICAL AUIDIT FOR ACCOUNT:
the funds of the society shall be deposited in an account opened with any scheduled bank at sirsa .the the cashier shall be competent to keep rs.10,000/-as cash in his hand and the cashier shall make payment in accordance with the bills passed by the president for a sum not more than rs.15,000/-and the bills passed by both cashier and president ,if the sum is more than rs.15,000/-the cashier will maintain regular accounts and send a copy of his accounts to the president and the cashier jointly by signing cheques.they shall be competent to withdraw a sum of rs.15,000/-,at a time.in case of withdrawal of more than rs.15,000/-at a time the cheque must be counter signed by the any member of the society alongwith president and the cashier.
source of income of the society shall include the subscription fee of the member and voiuntary donation from members and non members
for the audit of the account of the society an auditor may be appointed if felt necessary by the governing body.

18. The manner of making altering and resounding rules and regulations-
The general body shall be competent toamend the rules and regulations of the society at a specially convened meeting for that purpose but the aims and objects of the society will be amended only in a manner provided by the societies, registration etc.

19. The manner of dissolution of the society and such other matters as may be though expedient having regard to the nature and objects of the society-
a) The society may be dissolved by resolution of the general body of the society by 3/4th majority.
b) That any other matter will be decided by the governing body in accordance with the rules and regulations of the society from time to time having regard to the nature and objects of the society.
